Re: Ex-Biglaw, Current Lit Boutique Midlevel: AMA

Feel free to ask me anything, be it my time at biglaw, my reasons for leaving, or my current work as a lit midlevel at my boutique firm mostly complex tech/pharma litigation (patent, trade secret, or complex commercial with high tech or pharma focus). to the extent you're comfortable sharing - how ...

Re: so, how bout that proposed 35 usc 101

I have mixed feelings on it myself, on the one hand I think the supreme court has stretched quite a lot by adding those exceptions, but on the other hand I feel like this new one makes waaay too many things patentable (like possibly isolated sections of naturally occuring dna) Late response, but si...

Re: ConLaw

My guess was going to be crim law (scooped by Nony), with a specialty in appellate criminal practice/procedure. I can't think of any other even vaguely recognized niche practice group that would argue purely constitutional law issues as much as that. Obviously, there is probably someone out there th...

Re: Dallas Biglaw: litigation groups & clerkship bonuses

I am starting a clerkship in Texas and am considering looking to stay after. I did not work during the summer summer or go to law school in Texas (but was a summer associate in biglaw on the East Coast). T14/ competitive grades/ TX clerkship and ties, so I hopefully should be hire-able. Here are tw...

Oh right, good point. Luckily I don’t really feel bad for anyone at Quinn or WilmerHale on this.

Re: Patent / Soft IP

The IPR march continues. Not unconstitutional under Art. III or 7th Amend. Interesting that opinion specifically comments on it being narrow and does not consider any unraised challenges regarding whether patents are property for purposes of DPC or Takings Clause.

What is an "appellate characteristic" ? My read from the posts is that they are characteristics that impact or limit appellate options. To that, I agree (less on motion to dismiss stage generally). Anytime there are dispositive motions, appellate considerations (including preservation of rights and...

Yeah we're doing 101 in adv. patents right now and SCOTUS really needs to fuckin narrow the language...

Re: Ex-Biglaw, Current Lit Boutique Midlevel: AMA

Appreciate the info. Did you find your way in trade secret at the boutique, or did you bring the skills with you from the big firm? The DTSA was passed after I moved from the big firm, so that's probably where I picked most of it up aside from the advising piece (i.e. advising clients on how to pro...

How did you get involved in trade secrets? I'm looking to start in biglaw patent lit but I'm wondering how one "unlocks" the more niche stuff like trade secret, antitrust, etc. Antitrust can be implicated in patent lit, but most often only in the ANDA settlement/FTC issues (and really there it's mo...

Re: Litigation Boutique Associate - AMA

Bumping to ask- Conventional wisdom is that, a few years out of law school, grades/honors/etc. don't really matter, and people mainly look for "experience." Aside from "I worked at BIGLAW for 3 years," what exactly does that mean? Does that mean "I took 5 depositions for a $100m matter case"? Are y...

How does the future look for lit boutique associates who may not make partner? I can't speak to this generally, but at my firm we are not up or out. That said, the entire partnership (outside of named partners) are non-equity, so the move to partnership is not as difficult for the firm to give out ...
