Re: AUSA Salary?

The pay really sucks but if you live in one of the USAOs in "fly over country" it's pretty sweet. Same with Federal Defenders.

Re: How do local prosecutors and PDs handle so many cases at one time?

Quick answer: you don't. A large portion of cases get pled out via plea bargaining, and if the PD's have their shit together, the push the remaining load of cases to trial, and the DA/SA's drop a share of them and take their best or most serious cases to trial. I was a PD with more than two hundred ...

Did the judge excuse the witness when you asked?
So far when practicing before the other judges, I did not have to ask; they always excused the witness. But next time I'm before this particular judge I'll be sure to ask if necessary and see what happens.

Re: Litigation

I've never seen that, but I think I'd just ask "may the witness be excused?" before I started? Because no fucking way should a witness be making any kind of comment on the stand (or record) once the examination is complete. Yeah, I just had similar hearings with two other judges and they didn't do ...

Litigation

A thread on litigation generally. What do you do when the judge does not excuse the opposing party's witness, the opposing party doesn't ask the the witness to be excused, and the judge asks you to make an argument? It feels really awkward to ask for the opposing party's own witness to be excused, b...

Re: AUSA - taking questions

My understanding of the process is that when an immigrant is apprehended, the immigrant must claim a credible fear of returning to their home country and that that claim has to be adjudicated and denied before any prosecution can take place (that is, if a credible fear exists, they get put in asylu...

Are you on any kind of court appointed counsel list so you could rep defendants that the public defenders office has a conflict with? I have a friend doing this while in gov't. He's thinking about going private, but one firm hinted that they wouldn't too excited to have a JAG reservist. Despite the fact that discrimination against reservists is illegal, keep in mind that some firms probably do anyways.

Re: Federal attorneys: moving from non-GS to GS scale positions

I can speak to going from GS to a non-GS pay scale. I think it's general practice to try to at least match your prior federal salary. HR at my new agency explicitly told me that they tried to match my GS level salary in determining the offer (and they did). However, many agencies have rules that est...
