You don't always need to send one, but it is almost always a good idea. If you have a very strong resume and transcript (such as top grades from a T6), then you'd honestly still be fine without sending a cover letter. Should you always send a cover letter even if it is not asked for?

Two cases on when this happens
1) When it is email your resume and transcript to XXX. Do you include a cover letter anyways either in the body text of the email or as an attachment

2) When it is an online system that says mandatory is resume+ transcript but you can upload a cover letter anyways

I would absolutely not use a writing sample from undergrad - use something from law school. The lawyers who told you undergrad stuff is okay won't have any problem with law school samples, whereas someone who wants to see a law school sample will be put off by an undergrad sample.
